Get Registered as Listing Member (Paid) Terms of Use Terms of Use The following Terms of Use (hereinafter referred to as "these Terms") are established by MAXET Corporation (hereinafter referred to as "we," "our," or "us"), the operator of the Machine Freak (hereinafter referred to as "the Site"). Article 1 Application of These Terms These Terms outline the necessary compliances for members defined in the next article when using the Site, and they apply to all relationships between us and the members. Article 2 Members 1) In these Terms, "members" refer to individuals who have applied for registration on the Site by accepting these Terms through procedures designated by us and whose applications have been approved by us. 2) We may not approve registration if we judge it inappropriate to approve someone as a member. We may also revoke approval and erase registration even after approval. 3) Existing members are not allowed to apply for duplicate registrations. 4) We can revise these Terms without notifying members. The revised Terms apply to all members regardless of before or after the revision. The revised Terms will be announced on the Site. Article 3 IDs, etc. 1) Members will use the email addresses and passwords (hereinafter collectively referred to as "IDs, etc.") registered with us when using our services. 2) Members will be responsible for the use and management of their IDs, etc., and must not disclose them to or let them be used by third parties. Members will bear all responsibility for all acts and their results relating to our services performed by their IDs, regardless of whether the acts were performed by the members themselves or whether there was any negligence on their part. 3) If a member's ID, etc., is stolen or forgotten, or if it is found that a third party is using their ID, etc., they must immediately notify us of the situation and follow our instructions. 4) Members may not hold multiple IDs, etc. If it is discovered that a single member has performed duplicate registration and holds multiple IDs, etc., we may erase their registration. 5) If a member causes damage to a third party or us by unlawfully using the third party's ID, etc., they must compensate the third party or us for the damage caused by their unlawful use. Article 4 Registration Information 1) We will own and manage all registration information of members, including IDs, etc. There are two types of registration information: information that is disclosed on the Site (hereinafter referred to as "public registration information") and information that is not disclosed on the Site (hereinafter referred to as "non-public registration information"). 2) We will manage and handle members' registration information properly. As for the handling of personal information that can identify specific individuals among the registration information of members (hereinafter referred to as "personal information"), we will follow our separate rules set forth in "Handling of Personal Information on the Site." 3) Members will determine whether their registration information will be public or non-public by choosing the appropriate option on the registration screen at the time of registration at their own responsibility. It is assumed that members have agreed to have their registration information disclosed on the Site when they register as public information. 4) Members will bear all responsibility for any damage they suffer due to the disclosure of the information they entered as public registration information, and we will not bear any responsibility. Please be careful when entering public registration information. 5) Members must not make false declarations about all items of registration information they enter or declare at the time of registration. 6) If there are any changes in members' addresses, telephone numbers, or other registration information, members must promptly perform the designated change procedures. Members will bear all responsibility for any damage they suffer due to their failure to perform the change procedures, and we will not bear any responsibility. Article 5 Prohibited Actions of Members Members must not engage in the following acts (hereinafter referred to as "prohibited actions") when using the services of the Site, regardless of intent or negligence. If a member engages in a prohibited action, we may take appropriate measures, such as deleting the relevant parts of the prohibited action without prior notice, suspending the use of the services, or canceling the membership. In such cases, we will not accept any questions or complaints regarding these measures and will not be responsible for disclosing the reasons behind them. 1) Actions that violate public order and morals. 2) Actions that lead to criminal activities. 3) Actions that infringe upon the intellectual property rights (including but not limited to copyrights, design rights, patent rights, utility model rights, trademark rights, and know-how), portrait rights, privacy rights, and other rights of other members, third parties, or us. 4) Actions aimed at soliciting organizations, services, activities, etc. unrelated to the Site. 5) Actions that cause trouble or disadvantages to other members, third parties, or us, or actions that defame or damage the reputation and credibility of these individuals or entities. 6) Actions that obstruct the operation of the Site by using or providing harmful programs such as computer viruses, or actions that interfere with the operation of the Site by us. 7) Actions that constitute campaigning before elections, election campaigning, or similar actions, as well as actions that violate the Public Offices Election Act. 8) Actions that generate economic interests with other members or third parties by methods not approved by us, such as buying and selling, exchanging or gifting goods without value, opening or soliciting for pyramid schemes, or using the Site for commercial purposes. 9) Actions that are deemed harmful to minors. 10) Actions that send spam emails or emails to unspecified members, or actions that force or request others to read such emails, respond to surveys, or forward the emails to other members or third parties. 11) Actions of posting information that identifies individuals, regardless of themselves or third parties. 12) Actions of reprinting or redistributing emails from us or the content of the Site without permission. 13) Actions that violate laws and regulations. 14) Actions that promote any of the above. 15) Actions that we determine to have the potential to fall under any of the above items. 16) Other actions that we deem inappropriate. 17) Actions of posting third-party machinery equipment without permission. Article 6 Information Exchange Among Members 1) We shall bear no responsibility whatsoever for the exchange of information between members through the Site, and any acts incidental thereto. 2) In the event that any member, other member or third party incurs damage due to the information exchanged between members through the Site being infected with various viruses, the member who posted the information shall compensate for the damage. Also, we shall bear no responsibility whatsoever for such damage to any member or third party. Article 7 Ownership of Rights 1) Intellectual property rights (including but not limited to copyrights, design rights, patent rights, utility model rights, trademark rights, and know-how) and other rights related to the information posted on the Site by us, unless otherwise specifically stipulated, shall belong to us or other copyright owners, and members shall not use any information obtained through the use of the Site in any way other than as designated by us, unless approved by us. 2) In case any intellectual property rights (including but not limited to copyrights, design rights, patent rights, utility model rights, trademark rights, and know-how) are generated by the content posted by a member on the Site or the services provided through the Site, all such rights shall be transferred to us free of charge. This also applies to illustrations, catchphrases, plans, and other content submitted by members in response to solicitations conducted by us through the Site or the services provided through the Site. 3) The copyrights referred to in the previous paragraph shall include the rights prescribed in Articles 27 and 28 of the Copyright Act. 4) Members shall not exercise the author's moral rights (the right to make the work public, the right to have the author's name indicated, and the right to preserve the integrity of the work) against us and any third party who has legitimately acquired rights from us or has been legitimately licensed to use rights. Please note that the information on the Site may be published in newspapers, magazines, etc., or issued as publications. However, personal information such as names and addresses will not be made public without the prior consent of the member. For more details, please see "Handling of Personal Information on the Site." Article 8 Sending and Receiving Emails 1) When sending and receiving emails with us as a member, members shall use the same email address that they have registered with us. 2) We shall not be responsible for any disadvantage or damage incurred by the member as a result of sending and receiving emails with an email address different from the one registered with us. 3) We shall have the right to select and determine the information in the emails that we post on the Site or send to members. 4) When replying to emails from us, members shall do so in the manner specified by us. 5) If a member replies in a way different from the method specified by us, we shall not be responsible for any disadvantage or damage incurred by the member. 6) The content of the text in emails sent by members as members shall be based on the responsibility of the member themselves. Article 9 Advertisements for Goods, etc. Advertisements for goods, etc., are created based on materials provided by the companies selling or providing the goods, etc., and we shall bear no responsibility whatsoever for the contents of the advertisements, and members shall acknowledge this in advance. Article 10 Cancellation of Membership 1) In the following cases, we may cancel a member's membership without their consent. (1) If the member has misused their membership. (2) If the member has used the Site for profit-making purposes in a manner not approved by us. (3) If false facts are found in the member's registration information. (4) If it is found that the member has acted in a way that could threaten the credibility or social status of the Site. (5) If the member has misused our services or systems. (6) If the member has neglected to pay us for using our services. (7) If the member has violated any provision of these Terms. 2) If a member's membership is cancelled, the member shall lose all rights held on the Site. Article 11: Withdrawal Members who wish to withdraw from the Site must apply for withdrawal themselves. Applications for withdrawal can be made from the withdrawal page within our Services. Members agree in advance that all data accumulated in connection with the use of this Site will be lost upon withdrawal. Article 12: Liability 1) Apart from what is stipulated separately in these Terms, if a member intentionally or negligently causes damage to us or a third party in connection with the use of this Site or the services provided through this Site, the member shall compensate for the damage at their own expense and responsibility. 2) If a member has a dispute with a third party, or causes damage to a third party in connection with the use of this Site or the services provided through this Site, the member will resolve it at their own expense and responsibility. 3) If a member's posted information or other reasons attributable to the member cause us or a third party to receive complaints, claims, or other requests from other members or other third parties, and we or the said third party suffers damage, the member shall resolve it at their own expense and responsibility, or compensate for the damage suffered by us or the said third party. Article 13: Information & Services 1) We do not assume any duty to investigate or guarantee the completeness, accuracy, usefulness, and suitability of various information and services we provide. 2) We reserve the right to edit and reconfigure information provided by members and third parties, including manuscripts, images (including videos, still images, and sketches), voices, etc. Members shall not raise any objections to this. However, we do not assume any obligation to perform such editing. 3) We do not make any warranties as to the completeness, accuracy, usefulness, and suitability of the information and services provided to members. Even if damage (including physical, mental, and property damage) occurs to a member due to the information provided, we will not assume any responsibility. 4) If a member posts personal information or information that can identify an individual on the content of this Site that involves member participation, it will be considered that the member has obtained consent for the disclosure of personal information described in Article 4, Paragraph 3, and we will not assume any responsibility for this. Article 14: Deletion of Data 1) If the data accumulated by a member in the facilities for this Site (including data accumulated by a third party due to the settings of the database service) exceeds the period or amount specified by us, we may delete it without prior notice to the member. For operational and maintenance management needs of this Site, we may also delete the data registered by members in the facilities for this Site without prior notice to the members. 2) We do not assume any responsibility for the deletion of data based on the previous paragraph. Article 15: Interruption, Suspension of Service 1) We may temporarily interrupt or suspend all or part of the Services without the consent of the members in the following cases: - Routine maintenance, updates, and emergency situations of the system related to this Site and its network. - When it is difficult to provide the Service due to force majeure such as fire, power outage, natural disaster. - Other unexpected situations where we judge it difficult to provide the Service. 2) We do not assume any responsibility for any disadvantage or damage caused to members due to the situations in the preceding paragraph. Article 16: Changes, Suspension of Service Contents 1) We may change or suspend the content of the Services without obtaining the approval of the members. 2) We do not assume any responsibility for any disadvantage or damage caused to members due to the situations in the preceding paragraph. Article 17: Site Exemptions, etc. 1) We have the right to investigate, manage, and delete information exchanges between members, including posts on reviews and bulletin boards, community participation, and email exchanges, but we are not obligated to do so. 2) We strive to the utmost for the provision of the Services, the possibility of access, and the status of use, but we cannot guarantee it. 3) We do not assume any responsibility for troubles between members, between members and third parties, or between third parties. In the event of trouble, it shall be resolved by the parties involved, excluding us. 4) If a dispute arises concerning the Services provided by us, and we receive a claim from a member or third party and a judgment is made in court to acknowledge damages compensation or other responsibilities, and we respond to it, we can claim all costs related to the dispute (including damages, litigation costs, and attorney's fees) from the member who caused the trouble. 5) We do not assume any responsibility for difficulties, impossibilities, or cases where part or all of the Services are not completely or fully provided due to connecting to this Site. Users who can connect to this Site cannot pursue any responsibility for such faults from us. 6) We are completely exempt from any damage caused to members or third parties by the Services provided through this Site or this Site. 7) All disputes related to the Services provided by us will be governed by Japanese law, regardless of the content of the trouble, and the Tokyo District Court will be the exclusive court of first instance.
